What Is a Virginia Constitutional Amendment?

  • A constitutional amendment is a change to the Virginia Constitution, the Commonwealth's highest law.

  • It can create, remove, expand, or limit rights, powers, and government authority.

  • Constitutional amendments have greater legal authority than ordinary laws.

  • Unlike regular legislation, amendments cannot be vetoed by the Governor.

  • To be adopted, an amendment must pass two separately elected General Assemblies and then be approved by Virginia voters in a statewide referendum.

  • They can affect fundamental rights and government structure for decades.

  • Once approved, it becomes part of the Constitution and can only be changed through another constitutional amendment.

  • Constitutional amendments are intended for significant, long-term changes to how Virginia's government operates or how rights are protected or taken away.
